These Terms of Service (“Terms”) govern your use of the Mitosis platform and services operated by Mitosis Labs, Inc. (“Mitosis,” “we,” “us”). By accessing or using Mitosis, you agree to these Terms.
You must be at least 18 years old and capable of forming a binding contract to use Mitosis. By creating an account, you represent that you meet these requirements.
You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
Mitosis provides infrastructure for deploying, managing, and replicating autonomous AI agents. Agents operate in isolated environments and interact with third-party services on your behalf based on your configuration.

You retain ownership of all data you upload or create on the platform. By using Mitosis, you grant us a limited license to process, store, and transmit your data solely to provide the service. We do not use your data to train AI models.
AI agents are autonomous systems that act on your instructions. You are responsible for the actions your agents take, including messages sent, files created, and interactions with third-party services. Mitosis is not liable for unintended agent behavior, though we provide guardrails and monitoring tools to help you maintain control.
Paid features are billed on a credit-based or subscription basis as described on our pricing page. All fees are non-refundable except as required by law. We may change pricing with 30 days’ notice. Failure to maintain a positive credit balance may result in agent suspension.
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect availability. We will provide reasonable notice for planned downtime when possible.
Mitosis and its original content, features, and functionality are owned by Mitosis Labs, Inc. and are protected by copyright, trademark, and other intellectual property laws. Agent configurations and workflows you create remain yours.
Mitosis integrates with third-party services (Google Workspace, WhatsApp, Slack, etc.). Your use of these integrations is subject to the respective third party’s terms. We are not responsible for third-party service availability or changes.
To the maximum extent permitted by law, Mitosis Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Mitosis Labs, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your agents’ actions.
You may close your account at any time. We may terminate or suspend your access for violation of these Terms or for any reason with 30 days’ notice. Upon termination, your right to use the platform ceases. We will make your data available for export for 30 days after termination.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance. We will notify you of material changes via email or platform notification.
